Terms of Use (EULA)

These Terms of Use govern your use of the Pixel Earth mobile application and website ("the Service"), operated by SOS Corp Apps ("we", "our", "us"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. The Service

Pixel Earth is a location-based exploration game: you discover real-world places ("spots") by physically visiting them, photograph new spots, collect points and objects, and interact with friends. The Service requires a device with GPS and an internet connection.

2. Safety — play responsibly

• Always stay aware of your surroundings. Never use the app while driving, cycling, or in any situation requiring your attention.
• Do not trespass on private property, restricted areas, or dangerous locations to reach a spot. Spots are community-submitted; their presence on the map is not an invitation or a guarantee of lawful access.
• You are solely responsible for your own safety and for complying with local laws while playing.

3. Your account

You must be at least 13 years old to use the Service. You are responsible for the activity on your account and for keeping your sign-in method secure. You may delete your account at any time in the app (Settings › Account) or via our Data Deletion page.

4. Content you publish

When you submit a spot (photo, title, description, coordinates) or bury an artifact, you publish that content as described in our Privacy Policy. You keep ownership of your content and grant us a worldwide, non-exclusive, royalty-free license to host, display and distribute it within the Service.

You agree not to publish content that is unlawful, offensive, infringing, deceptive, or that exposes personal data of others (e.g. photographing identifiable people without consent, or private interiors). We may reject, hide or remove any content at our discretion, and suspend accounts that abuse the Service, cheat (including GPS spoofing), or attempt to disrupt it.

5. Virtual points and objects

Points, objects, avatars and other in-game items are virtual content with no monetary value. They are licensed to you for use within the Service, are non-transferable outside the game's own features (such as gifts), non-redeemable and non-refundable except where required by law. We may adjust game balance (prices, rewards, item effects) at any time.

6. Purchases and subscriptions

Points packs are one-time purchases (from €1.99 to €19.99) processed by Apple In-App Purchase, Google Play, or Stripe depending on your platform.

Subscriptions:

• Pixel Voyager — €2.99 per month
• Pixel Legend — €4.99 per month

Subscriptions renew automatically each month until cancelled. Payment is charged to your Apple ID, Google account, or card (Stripe) at confirmation of purchase, and renewal is charged within 24 hours before the end of the current period. You can cancel at any time — via your device's subscription settings (App Store / Google Play) or the subscription management screen in the app (Stripe) — and you keep the benefits until the end of the paid period. Prices may vary by region and are shown before purchase. Refunds for purchases made through Apple or Google are handled by those stores under their own policies.

7. Availability and changes

We provide the Service "as is" and "as available". We may modify, suspend or discontinue features at any time. We do our best to keep the Service running but do not guarantee uninterrupted availability, and community-submitted map content is not guaranteed to be accurate.

8. Limitation of liability

To the maximum extent permitted by law, SOS Corp Apps shall not be liable for indirect, incidental or consequential damages arising from your use of the Service — including damages resulting from your physical activity while playing (see section 2), reliance on community-submitted content, or loss of virtual items. Nothing in these terms excludes liability that cannot be excluded under applicable law, including your statutory rights as a consumer in the European Union.

9. Termination

We may suspend or terminate accounts that materially breach these terms (cheating, abusive content, disruption of the Service). You may stop using the Service and delete your account at any time. Sections 4, 5, 8, 10 and 13 survive termination.

10. Governing law

These terms are governed by French law. Consumers residing in the European Union also benefit from the mandatory provisions of their country of residence. Disputes may be brought before the competent courts of France or of your country of residence, and you may use the EU Online Dispute Resolution platform.

11. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by the "Last updated" date above, and continued use of the Service after changes constitutes acceptance.

13. Additional terms for the Apple App Store

If you obtained the app through the Apple App Store, the following terms also apply, as required by Apple's licensed application terms:

• Acknowledgement. This EULA is concluded between you and SOS Corp Apps only, not with Apple. SOS Corp Apps, not Apple, is solely responsible for the app and its content.
• Scope of licence. The licence granted to you is limited to a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
• Maintenance and support. SOS Corp Apps is solely responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance and support services.
• Warranty. SOS Corp Apps is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.
• Product claims. SOS Corp Apps, not Apple, is responsible for addressing any claims relating to the app or your possession and/or use of it, including product liability claims, any claim that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
• Intellectual property. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, SOS Corp Apps, not Apple, is solely responsible for the investigation, defence, settlement and discharge of such claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. SOS Corp Apps — contact@sos-corp.fr — for any questions, complaints or claims regarding the app.
• Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example your mobile data provider's terms).
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
